1. Parties and purpose of the contract
These terms govern the contract between Radicio Realis, S.L. (NIF B56886690, C/ El Sebo, 1, Lajares, La Oliva (Las Palmas), España, hello@fincaclaro.com), trading as Finca Claro, and the client who orders a Property Check through this website.
2. The service
The Property Check is a report based on documents about a specific property in Spain. We obtain the nota simple and Catastro record ourselves; both are included in the 149 € price. You only need to send the listing link or address and any documents you already have. The report explains these records, identifies discrepancies and questions that remain unanswered, and suggests next steps.
The Property Check is not:
- legal or tax advice, or a contract review;
- a valuation or a technical building survey;
- a holiday-rental permit, or a guarantee that the purchase is free of risk.
If you need legal advice, GLEX & CO can provide it under a separate engagement, with its own terms and fee.
3. Price and payment
The Property Check costs 149 € per property, taxes included. There are no other charges unless agreed in writing before payment.
Payment is made online through a secure payment provider, after we confirm that we can fulfil your request.
4. How the contract is made
- You send a request with the property details.
- We check whether we can prepare the report and send you the scope, the total price and the delivery time.
- The contract is made when you accept these terms and pay.
- We send you confirmation of the contract on a durable medium (for example by email), with these terms and the withdrawal form.
The contract can be made in Spanish, German or English.
5. Delivery time
We deliver the report within 3 working days after we receive payment and the necessary property details. If a public register does not supply a document in time, we will tell you and agree either a new date or withdrawal from the contract with a full refund.
6. Your cooperation
You must give correct property details and supply the documents you have. The report is based on the information available on the date stated in the report.
7. Right of withdrawal
As a consumer, you can withdraw from the contract within 14 calendar days of its conclusion without giving a reason (Article 102 of the Spanish consumer protection act, LGDCU).
To withdraw, send a clear statement to hello@fincaclaro.com. You can use the model withdrawal form, but you do not have to. It is enough to send your statement before the period ends.
Refund: we refund all payments without undue delay and at the latest within 14 calendar days of receiving your withdrawal, using the same means of payment, at no cost to you (Article 107.1 LGDCU).
Service started during the period: if you expressly ask us to start the report before the 14 days end and then withdraw, you pay a proportional amount for the part of the service already provided (Article 108.4 LGDCU).
Loss of the right: once the complete report is delivered, you lose the right of withdrawal if you expressly asked us to start and acknowledged that you would lose the right on completion (Article 103(a) LGDCU).
8. Liability
We prepare the report with professional care. We are not liable for errors or missing information in public registers or third-party documents, or for decisions you make without the professional advice the report recommends. Nothing in these terms limits your statutory consumer rights.
9. Complaints and dispute resolution
Send any complaint to hello@fincaclaro.com. We will respond as soon as possible.
Alternative dispute resolution (Article 40 of Spanish Law 7/2017): we have not joined any consumer alternative dispute resolution body.
You can also contact the consumer services of your region or country of residence. Information on dispute resolution bodies in the EU: consumer-redress.ec.europa.eu.
10. Applicable law
Spanish law applies. If you are a consumer, you can go to the courts of your place of residence and you keep the protection of the mandatory rules of your country of residence.
