Gestoría in Spain: what does the professional role cover?

Article 1 of the profession’s statute describes paid work on administrative procedures. It excludes legal work reserved to lawyers. Gestores administrativos statute, article 1

Do not decide from the office’s name alone. Ask who will perform each task and under which professional role. If the office also offers legal work, request the named lawyer and their written scope.

Which should you contact first?

Our recommendation: for a defined administrative task, request a gestoría’s written scope first. For unclear records on a shortlisted property, compare the Property Check with any explanation your advisers already provide. Avoid paying twice for the same work.

For a disputed charge, proposed contract wording, payment recovery or uncertainty about legal permission, go directly to a lawyer. Do not assume that a submission receipt resolves the underlying legal question. Ask for the relevant decision or written professional advice.

Agree responsibility before paying

Send a short request: “I need [task] for [property]. Please confirm who is responsible, what you need from me, what you will deliver, the total fee, the expected timing and what happens if further work is needed.”
